Richard T. Sampson currently maintains a mediation practice in Crownsville, Maryland and is a member of the Maryland and District of Columbia Bars. He retired as Principal from the law firm of Semmes Bowen & Semmes after thirty years of service.
He was Chair of that firm's Labor and Employment Law practice group, representing management in all areas of labor and employment law. This included development and implementation of Affirmative Action Programs for government contractors and subcontractors; defending OFCCP compliance reviews; writing employee handbooks; investigating and defending charges of discrimination; appearances before administrative bodies (state, local and federal charged with enforcing nondiscrimination laws and regulations); and Equal Pay Act matters. He has been a principal counsel in over 40 reported cases and has litigated cases in the 1st, 2nd, 3rd, 4th, 5th, 6th, 7th, 8th, 9th Circuits, the District of Columbia Circuit and the Federal Circuit, the Equal Employment Opportunity Commission, the GAO Personnel Appeals Board, the Merit Systems Protection Board, the Occupational Safety and Health Review Commission, the National Labor Relations Board, and other agencies.
Mr. Sampson participated in presentations, throughout the United States, Europe and Canada presenting specialized legal education on such topics as: Affirmative Action Program development; the use of statistics in class actions; establishing the validity of employment selection tests; trial tactics; and others topics covering the full range of labor and employment related CLE Although the greater portion of his practice was as a management attorney, he has represented plaintiffs in private and federal and federal sector discrimination cases. As a Partner (later Principal) specializing in employment law Mr. Sampson participated in establishing employment practices and management of the Firm.
Mr. Sampson developed expertise in the use of statistics and psychometrics in discrimination matters. He was hired by the Metropolitan Water Reclamation District of Greater Chicago to perform a job analysis of the position of Affirmative Action Director, and to develop a valid selection test for the position. He has been qualified as an expert on testing and selection and has made numerous presentations dealing specifically with affirmative action, testing and selection. He joined the American Statistical Association, the International Personnel Management Assessment Council (serving as Chair of the Legal Committee for several years) and the Personnel Testing Council of Metropolitan Washington. For many clients he served as a human relations advisor as well as legal advisor. For example, he was on a team that developed and implemented the recruiting, hiring and training of the entire nonexempt workforce for a new manufacturing facility of Mack Trucks, Inc., in Winnsboro, South Carolina and led a team that developed valid selection procedures for Account Executives for Dean Witter, a national brokerage firm.
Mr. Sampson was elected as a Founding Fellow of the College of Labor and Employment Lawyers, August, 1996
