Selected Cases
Roberts v. Texaco, United States District Court for the Southern District of New York, 1994. Nationwide class action alleging racial discrimination in promotion in which Richard T. Sampson was primarily involved in connection with selection, validity and related discovery issues regarding the total affected employee promotion and selection process. Mr. Sampson also participated in the fashioning of affirmative action provisions ultimately incorporated into the settlement agreement, which was valued at $175 million.
EEOC v. Kmart Corp., 796 F.2d 139 (6th Cir. 1986); 694 F.2d 1055 (6th Cir. 1982). Related appeals involving EEOC actions to enforce a subpoena in connection with nationwide class action alleging unlawful racial and sexual discrimination in recruiting, hiring, job classification, assignment, promotion and segregation in violation of Title VII of the Civil Rights Act of 1964. Settled with no monetary payment.
Moore v National Association of Securities Dealers., 762 F.2d 1093 (D.C. Cir. 1985). Defense of racial discrimination class action, brought pursuant to Title VII of the Civil Rights Act of 1964, involving alleged discriminatory practices in hiring and promotion. Successfully defended with no monetary relief.
Johnson v. National Association of Securities Dealers. Inc., 731 F.2d 995 (D.C. Cir 1985). Defense of racial discrimination action brought pursuant to Title VII of the Civil Rights Act of 1964.
Miller v. Staats, 706 F. 2d 336 (D.C. Cir. 1983). Prosecution of class action, brought pursuant to Title VII of the Civil Rights Act of 1964 involving allegations of discrimination against class of white male employees. Case settled, attorneys fee issue published, fees collected by Mr. Sampson.
Bartelson et. al. v. Dean Witter Reynolds, Inc., 643 F.2d 1334 (9th Cir. 1980). Appeal of a subpoena enforcement action implicating Section 706(b) of Title VII of the Civil Rights Act of 1964, related to nationwide class action alleging racial and sexual discrimination. The lawsuit involved all aspects of discrimination as to recruiting, hiring, classification, promotion, and transfer. Settled favorably to client.
Firestone Synthetic Rubber & Latax Co. v. Marshall, 507 F. Supp. 1330 (ED. Tex. 1981). Successful declaratory judgment action on behalf of employer in its implementation of affirmative action plan implicating Executive Order 11246 and Title VII of the Civil Rights Act of 1964; enforcement of the "any difference rule enjoined."
Herrod v. Peoples Drug Stores, Inc., 417 F. Supp. 747 (D.DC. 1976). Defense of racial discrimination action brought pursuant to Title VII of the Civil Rights Act of 1964, in which plaintiff sought, but was denied, class certification.
Johnson v. Reno, United States District Court for the District of Columbia, 1993. Prosecution of nationwide class action, brought pursuant to Title VII of the Civil Rights Act of 1991 (as amended) by FBI agents alleging racial discrimination in promotion and other terms and conditions of employment. Case settled favorably to clients.
Stewart; et. al. v. Bentsen, United States District Court for the District of Columbia, 1993. Prosecution of nationwide class action, brought pursuant to Title VII of the Civil Rights Act of 1991 (as amended) by Alcohol, Tobacco and Firearms Criminal Investigators alleging racial discrimination in hiring, promotion and other terms and conditions of employment. Case settled favorably to clients.
Jones v. Eastman Kodak Co., Inc, Circuit Court for Baltimore City,1986. Nationwide class action, brought under various state consumer fraud statutes, regarding exchange program offered by Kodak to holders of its instant cameras following Kodak's withdrawal from the market pursuant to a 1985 order by the United States District Court for the District of Massachusetts that Kodak infringed upon various Polaroid patents. Richard T. Sampson was also involved in advising lead, in-house counsel in handling Sampson v. Eastman Kodak, filed shortly after Jones in the Circuit Court of Cook County, Illinois and which was settled after the case was certified a nationwide class action.
0'Bannon and EEOC v. Merrill Lynch, Pierce, Fenner & Smith, Inc.. United States District Court for the District of Western Pennsylvania, 1976. Defense of nationwide class action, brought pursuant to Title VII of the Civil Rights Act of 1964, in regard to alleged sexual and racial discrimination against women, African-Americans and Hispanics. The lawsuit, which involved intervention by the EEOC pursuant to Section 707 of Title VII, encompassed all aspects of alleged discrimination related to hiring, promotion, transfer, pregnancy, and other terms and conditions of employment.
Rodriguez v. Drexel Burnham Lambert, Action brought by Equal Employment Opportunity Commission (Commissioner Rodriquez) in 1986, stayed by bankruptcy proceedings. Case involved defense of nationwide class action implicating Section 707 of Title VII of the Civil Rights Act of 1964 and involving charges of patterns and practices of racial discrimination.
